Government Employee Pension Fund (GEPF) Divorce Claims

In the past, the “clean break principle” did not apply to the Government Employee Pension Fund.  But in 2011 the Cape High Court declared the law governing the GEPF unconstitutional and ordered the government to remedy the situation.

The Bill has been enacted and legislation has been amended – Government Gazette Vol 558 No 34864 of 14 December 2011.  (See Insertion of section 24A in Proclamation 21 of 1996).

Former spouses (the non-member) of members contributing to the GEPF can now claim their share of the fund as stipulated in their divorce order and don’t have to wait until retirement, resignation or death.

Since the enactment of the new law, the GEPF has received an unprecedented number of divorce claims and this might cause a delay in the finalization of a claim.  The GEPF however, has 60 days from date of submission of the claim to effect payment.

      Our divorce was finalized in july 2017, in our decree of divorce it was stipulated that we share our assets, it was not indicated that we share our pensions where as we agreed so, my ex wife and her lawyer did not submit the affidavit that we drafted. Can I still go back to court and request to claim from her pension.

            I did fill the claim forms at GEPF January this year, when I call for follow ups I was told my file is in the hands of legal advisers for GEPF and they don’t know why it is delayed because it is suppose to be at Sars now and the 60 days of claimed have expire on the 13th of March.

          Hi. I was divorced on 25/6/20 in High Court. Only received typed assets and liabilities from my attorney end August 2020 , with his bill. The rough handwritten assets and liabilities on the divorce day, it now turns out had numerous mistakes/ fraud. For eg. My wife gave a bank statement on the day, with R100k missing, my car of R161k was left out and my personal loan was R100k short, house selling price R29k short.             Good day Elizabeth, Once the GEPF finalized a retirement payment (or any other form of pension pay-out) to the member they cannot process a divorce claim. The matter needs to be negotiated between the parties. You will therefore not be able to claim anything at GEPF.

            Please advise .. what happen when the non-member died in 2009 – did not claim the pension benefit – the divorce was finalised in 2004 and there was a claim in divorce action for some % of the pension.           Dear Thapelo, it all depends on your marriage regime and how it is stipulated in your Divorce Decree. If the Divorce Decree stipulates “from date of marriage” it will only be calculated for the period of marriage. Alternatively it will be for the whole employment period. Regards

    You can read the following post, it explains that the member (your ex-husband) has to repay the portion of the pension interest allocated by the court and paid to the former spouse (which is you). In other word, you will not have to repay it, but he has to.

    • That you do have a claim on your ex-spouse’s pension fund.
    • The name of the Fund (GEPF).
    • The percentage you are entitled to.

    I have put in my claim in January 2017. In March 2017 they were suppose to pay out the pension fund from our divorce. I was informed that the salary scales is not correct, and has been requested again from Police HR. We are now, in June 2017… and this salary scale is still not even done. I have asked them what is going on, and they keep telling me, it has to be updated. 5 Months later.. and I still didn’t receive my divorce pension fund.
    I’ve asked them how this works, and they said, WHEN they get the salary scale, it will go to SARS for tax, and then only get paid out. But it’s been months now?

      Good day my nane is Dipuo i went straight to gepf offices to submit my 50 percent last year January now after last year around September I’ve been calling and calling since before they said my documents are in finance and after they said i mast go back to lawyer how was helping and asked her for an edorsement letter and they said she knows what to do and i did but since she’s been promising to get me the endorsement letter since last year and now its a new year and shes not answering my calls now i really don’t know what to do anymore. And am between jobs and i have three kids from my marriage am really struggling.

    I’m assisting a family member who is divorcing a SAPS member and has been told by both the wife’s and his own lawyers that his pension portion will only be paid out on her retirement date, while he is liable for his half of the communal debt now. The court has rejected the first submission of signed divorce papers as all mention of the pension settlement has been omitted. We suspect collusion between the lawyers to protect the member’s pension fund. How can we proceed.

    In the past, the “clean break principle” did not apply to the Government Employee Pension Fund. But in 2011 the Cape High Court declared the law governing the GEPF unconstitutional and ordered the government to remedy the situation.
    The Bill has been inacted and legislation has been amended – Government Gazette Vol 558 No 34864 of 14 December 2011.
    Former spouses (the non-member) of members contributing to the GEPF can now claim their share of the fund as stipulated in their divorce order and don’t have to wait until retirement, resignation or death.

    Thank you for this site. I have a another family member who divorced her policeman husband 10 years ago. Through ignorance on her part and there was no mention of the SAPS pension in the divorce settlement. I understand the previous ruling was in place at the time meaning she would be paid out on his retirement from the force. He is retiring (30+ years service) in April this year. She has since passed on and he has remarried but leaves behind their estranged children and grandchildren. Do the children have a claim on their mother’s portion of his pension ?

    In order to have a valid claim against the GEPF it must be specifically stipulated in the divorce decree that the non-member has a claim. If it is not stipulated the GEPF will not make payment. If it is stipulated a claim can be made against the member by the executor of the deceased ex-spouse.

    The GEPF will only pay a divorce benefit on grounds of a valid Divorce Court Order. In other words,if it is stipulated in your divorce order/settlement that your ex-spouse can claim against your pension, GEPF will pay him the benefit without further permission from your side and/or informing you of this. I do not understand your remark about “some third party” but if you are referring to the debt against your Pension, you can read my article

    Do you only need the pension number to stipulate it in your Divorce Settlement? If so, your attorney can use the following citation and it will be accepted by GEPF:
    “In terms of Section 7(7) and 7(8)(a)(i) and (ii) of the Divorce Act 70 of 1979 it is agreed that 50% of the pension interest, due and assigned to the (member), held in the Government Employees Pension Fund be paid to the (claimant) by the aforementioned fund when any such pension benefits accrue in respect of the (member), up to the date of the granting of the Decree of Divorce. An endorsement to this effect must be made in the records of the abovementioned Pension Fund, member ID number XXXXX.” ‘

    The GEPF will only make payment to an ex-spouse on grounds of a Court Order (Divorce Decree) ordering them to do so. If you and your ex-spouse never agreed to this and it is not stipulated in your Divorce Decree, he cannot claim from the Fund.

      This is my concern as well. I divorced in 2006 and the decree does not mention any other order except the maintenance and “that the agreement between the parties filed of record be and is hereby made an order of court”.
      GEPF wants me to provide a settlement agreement which was never given to me. I retired in June and have been struggling to get payment from them. Please advise.

However they asked if I was divorced before, I never gave it a thought as it was a DIY divorce more 12 years ago and I was married less than a year.       Good day I’m divorced 22yrs. I’ve been trying to get my share of the pension since 2018. The order was amended this year June, the GEPF received the order , no reply . I went to court in June this year, ex said he won’t give me any money , so the order was granted, I’m still waiting for payout almost 5months since June .         Dear Doreen, the GEPF amended the rules regarding pension debt on divorce. The amendment now ensures that rather than creating a debt, there will be an adjustment to the member’s pensionable service following the payment of a divorce settlement by the GEPF. This means that the benefit that will be paid to the member upon retirement/resignation will now be decreased by reducing the members’ years of pensionable service to take into account the pension interest of the member that was given to the spouse upon divorce. Post 22 May 2020 all members who have a legal divorce claim against their pension will be subjected to the service reduction model.     Dear Keitumetse, I trust you are working through a lawyer to finalize your divorce. The GEPF takes more or less 60 days to pay-out pension benefit to a member once he/she resigned. I suggest you ask your lawyer to apply for an urgent Court Interdict preventing the GEPF from paying him until the divorce is finalized and you can apply for the divorce benefit.I advise that this interdict is then hand delivered to the GEPF to ensure they receive it; also ask for proof of receipt.     my ex-husband got his provident fund in 2012 whilst were legally married but in separation. he moved out in 2011. I demanded my 50% share and did not give me until he finished it. he is working for a new company now. He filed the divorce and claims my 50% pensions. we have a daughter, she is 15 yrs old. He has a bond house where we still live in it. regarding with the provident fund he got in 2012 he says it must be deducted from my 50% pensions he has claimed from and be given the balance. Do GEPF does that when someone did not share his provident fund and claims his 50% share from his spouse. Do I have to refuse to share mine to him if he has nothing on the table. Regarding with the bond do we have to sell the house and share the money or do I have to give him back as we are not going to split our pensions.

In other words, should your ex-spouse submit all the documents to claim his 50%, the GEPF will pay according to the Divorce Decree.       Yes she can resign and apply for her pension benefit. If the GEPF is not informed of the pending divorce there is a possibility that they will pay-out the benefit before the divorce is settled. I suggest you ask your lawyer to draw up a letter informing the Fund of the pending divorce. Also, rather submit the letter personally at their office than emailing/faxing it.     I got divorced on 19/11/1999. My ex-spouse went to court on that day , and I have no idea if it was in the Pretoria or Johannesburg High Court. I have been trying to obtain a copy of my original divorce decree but I have no success as it cannot be located in the archives. I know I need to submit a copy of the original divorce decree upon my retirement in 2026 but what is the situation when a copy of the divorce decree cannot be submitted TO rhe GEPF. my ex-spouse also does not have a copy of the decree anymore.       Can you please assist me with information whom I can contact at the Johannesburg central divorce court to physically go and search for my case in their records in order to try and locate a copy of my divorce decree. I already went to the Pretoria High Court and searched their court case registers since 1998 until they went electronic but it was definitely not there.     Hi. Can you please assist me here. I resigned on the 31st of March 2019. I submitted all the documents via my department. Salary stopped showing that my resignation was received. I also got a letter from the Department. Two weeks back I contacted GEPF and they said they haven’t received my documents from the Department. I had to start all over again and submit the documents via the HR offices, which I’m certainly sure they didn’t submit to GEPF. Is there anyway you can assist of fast tracking the process? Like submitting to GEPF straight instead to via the HR. Because now on calculations if they happen to submit it, it will take me another 2 months waiting period. In totally 5 months. Can you help in this situation?

    I’m asking on behalf of my aunt.
    She was married to her husband for over 9years but have been together for 18 years with three kids. They divorced in 2003. Over the years she lost lot of money trying to get a fair settlement from her ex-husband. Her husband has since remarried and resigned. My aunt never got anything. Is it possible for a divorce settlement to omit the part of my aunt getting portion of her ex husband’s pension fund? Someone said if it was not initially there on the settlement then she’s not supposed to get anything. It’s very sad to watch her over the years struggling with her kids and unemployed. Please provide advice so that she can get closure.

      Dear Khuthala, your mother can claim if it is stipulated in the Divorce Order/Settlement. The GEPF does recognize a customary marriage and the wife will be able to claim. You can go to the Employer where your father worked and submit your application with the HR.     Good morning,

    I am divorced and my husband went on pension in June last year. We divorced in 2010 and the divorce decree and divorce settlement state that we need to both share 50%/50% of our pensions as we both work for the state.

    I only lodged my documents with GEPF in December 2019, only to discover that he had been paid all his lump sum including what was due to me in June when he went on pension. When I called GEPF they said they work based on the divorce decree which needs to be sent by the court and the member, being me, which I only sent in December 2019 to make the payment allocation.

    I suspect he did not submit the divorce decree and agreement when he claimed last year. What I want to know is, will I lose out on this pension payout given that I submitted the documents in December? Is it not the responsibility of GEPF to verify a persons marital status prior to payment being made given that people can lie.

    Please advise, and indicate if legal assistance in the matter can lead to me being paid my 50%.

Depending on your marriage regime your ex-spouse is either entitled to 50% of the whole pension value or only for the time of marriage.     I was divorced in August last year , my arttoney claimed on behalf of me. It took GEPF two months to write me a formal letter stating I must claim 50% from my ex husband pension fund and another choice form to fill in . When I called inquiring about the first claim , i was told there was an error to that claim.
    On the 11th on November last year i personally went to GEPF offices in Cape Town , which i submitted another claim.
    I called since January this year was told my claim was within their Finance Department , it hasn’t been finalised yet.
    I called each week since then , I was told the same story which i decided not to follow up again
    It is the 3rd of March today I am still haven’t been paid

And also I would like to know if she’s still accumulating from my pension from the day of divorce until now?

      Dear Walter, you can submit a certified copy of the Divorce Decree in the meantime but your ex-spouse must submit the Choice Form with her personal details herself. The divorce benefit is paid up until the date of divorce and it does not accumulate interest.

It all depends how you are married but as mentioned, please get sound legal advise.       Dear Malebo, you must ask your lawyer to submit a Motion of Notice urgently to the GEPF to prevent them from making payment to your spouse before the divorce is finalized. In this way the GEPF will withhold his pay-out until they have received the Final Divorce Decree. If they do not receive this they will make payment to him and then you cannot claim your share. Your lawyer must make sure that he submits it personally at the nearest GEPF regional office as they will not accept an email or faxed copy. You can contact me should you require further information.       Good day Sherryl, do I understand correctly; did you only found out recently that you are divorced? If your husband retired he would have been obliged to submit the Divorce Decree. If it is stipulated in the Divorce Decree that you are entitled to a percentage of his pension, the GEPF would have kept it aside for you.       Dear Maggie, yes you can claim the arrears maintenance. You need to submit your claim at GEPF as soon as possible before the death benefit is paid out. I suggest you submit an original certified copy of the Divorce Decree, the maintenance order stipulating the arrears, a Z894 (bank form), latest bank statement and an original certified copy of your ID.     My parents divorced in June 2010 and my mother was a gepf member. The divorce decree is silent on the issue of pensions and my father resigned from his work in 2026 and my mother made no claim against his pension. Now my mother passed away and my father wants 50% of my mother’s pensions. Can you kindly advise whether he has a claim against my mother’s pensions and whether it is necessary for a member to update her beneficiaries after divorce? Further what will happen if my mother did not change update her beneficiaries after the divorce.

      Good day Joy, your father will not be able to claim 50% relating to a divorce claim if it is not stipulated in the Divorce Decree. With regards to the updating of beneficiaries; I cannot confirm how GEPF will make payment. Usually if the nomination form is not updated, they will make payment to biological children but unfortunately I cannot say for certain. I suggest you visit the Employer where your mother worked at the time of her passing and submit the necessary documents to claim as her biological child (all other children must do the same).

    Good day…I sent my claim and divorce degree order wording wording is incorrect so GEPF needs correct order as it was written 1st defendant and 2nd defendant and still pending. How do rectify this mistakes.

      Dear Mpumi, unless you submitted the required documents which include a Choice Form with your personal banking details, the GEPF will not process the claim.     Hi can I please ask.. I’m facing an issue here my husband passed away 2013 and we were legally married and now the family went to the office and claimed the money and took a random lady claiming he was paid lobolo I don’t know when I don’t even know that lady and now they are telling me that the lady is a beneficiary so what puzzled me is that they want my marriage certificate and death certificate and the letter of authority from me so that the lady can get money is that even possible

      Good day Shaun, a pension fund forms part of one’s assets. You therefore can claim a share when divorcing. It all depends on how you are married and how it is stipulated in your Divorce Order.     I have divorced I think 2002 and by then I never knew that I will work for government. I resigned on the 31 August 2022 and it was seven years on the service.The process of payment from GEPF is so slow and I called them several times and they told me it’s on GEPF legal section because I am a devorcee.Why my claim is involving a person who have applied for a devorce me.

      Dear Sisa, I assume you have resigned and waiting for your pension pay-out? When a member resigns and it is noted on the system that they are divorce, it must be verified by the Legal Section that there is or isn’t a share due to the ex-spouse. The Legal Section will verify the Divorce Decree after which it will be sent for further processing to effect payment.     Are you able to assist in allocating my ex-husband’s GEPF Membership Number. He recently passed away and apparently the GEPF Special Programs Department is looking into his history and determined he was married. I am unable to find an e-mail address for them and they do not have any of my details as all have been changed after our divorce a couple of years ago and the GEPF Call Centre wants a Membership Number which I do not have anymore.

      Good day Burger, once a member retires and receives a monthly pension, the GEPF will not assign a percentage to an ex-spouse. This needs to be agreed between the parties. Regards

    Hi can you please help. my wife and I divorced on 19/01/2023, and I have exited services, I was employed in government for 15 years and the 60 days for her payout are all overdue. what must I do as she is always bothering me and i cannot move on with my life as this is also taking a toll on me personally as the GEPF has not paid her, I have called the GEPF regarding update but they say the file is at forensic section what must I do to move on.

    Please Help and call me on this number as I have on 066*******

        Good Day

        There are two files with THE GEPF ( Termination of service and Divorce) the agent said to me on the (10/08/2023) that the file is at Special Projects (Payments Section) and then on the (18/08/2023) they say the file is at Forensic section( For the second time) with a Mr. Isac (082*****) and the AGENT at GEPF give me his cell phone number(082****) to call him, I called him and he said I should send him my details and I did send the details to him( I.D. NO, Pension Number, Persal Number), I then called him and he said he will look into the matter, but when I called him he drops my calls, I also send him please call me and he this not response and the turnaround time of (60) days have been on the (22/08/2023), they have expired as the first time this file was at the Forensic section it took a Month for it to leave that section, If you can help me I will be grateful as I am running out of time as I have relocated from Nelspruit to Piet Rief and need to take the refer letter to my new clinic as the clinic will not give me any medication anymore
        I have no email or smartphone for you to send me any documents but please call me on(0660*****) and will will take it from there.

    Good day

    I would like to enquire on how long does it take for Legal team to release payment, I have submitted my GEPF Divorce claim on the 30th June 2023 and when I called last Friday they told me it’s with Legal team & it’s been there for 3 weeks now I’m worried it might take more than 60 days as it is supposed to be paid within 30-60 days after they have received the claim.

    Should I wait for the 31st of August to see if they pay and if they don’t what should I do? My claim had no disputes

    I HAVE WRITTEN TO THE GEPO AND HAVE NO RESPONDS SO MY CASE OF DIVORCE IS AT REISSUE AND MY TERMATION IS AT LEGAL/PAYMENY BUT STILL THERE IS NO PAYMENT FROM THE 20/11/2023 TO DATE AND THE CALL CENTRE AGENTS TELL ME IS WILL TAKE 4 TO 6 WEEKS TO REISSUE THE OUTSTANDING BANKING DETAILS AS THE DIVORCE CASE WAS RETURNED DUE TO OUTSTADING BANKING DETAILS ON THE Z894 FORM AND MY TERMATION IS AWAITING FOR THE DIVORCE TO BE PAID SO MY CASE IS AT GEPF FOR ONE(1) YEAR KNOWN AND I HAVE NO HOPE OF GETTING PAYMENY SOON
